Terms of Service
These Terms of Service ("Terms") govern your use of the TrustVyuh website and any services we provide. By accessing our website or engaging our services, you agree to be bound by these Terms. Please read them carefully.
1. Definitions
"TrustVyuh", "we", "us", "our" refers to TrustVyuh, a cybersecurity and digital product development company based in India.
"Client", "you", "your" refers to any individual or organisation that accesses our website or engages our services.
"Services" refers to website development, mobile app development, custom software development, cybersecurity consulting, penetration testing, and related services offered by TrustVyuh.
"Deliverables" refers to any work product, code, design, documentation, or other output produced by TrustVyuh for a Client under a service agreement.
2. Use of This Website
You may use our website for lawful purposes only. You agree not to:
- Use the website in any way that violates applicable local, national, or international laws or regulations
- Attempt to gain unauthorised access to any part of our website, servers, or systems
- Transmit spam, malware, or any other malicious or unsolicited material
- Scrape, crawl, or systematically extract data from this website without our written permission
- Use the website to conduct any form of penetration testing or security scanning without explicit prior consent
We reserve the right to restrict or terminate access to our website for any user who violates these Terms.
3. Our Services
All services are subject to a separate written service agreement or statement of work ("SOW") agreed between TrustVyuh and the Client. These Terms operate alongside any such agreement. In the event of conflict, the specific service agreement takes precedence.
Scope: Any work outside the agreed scope will be quoted separately. We will not begin out-of-scope work without written approval.
Timelines: We provide realistic timelines and will communicate proactively if anything changes. Delays caused by the Client (e.g. delayed approvals, feedback, or content) may extend project timelines accordingly.
Penetration Testing: All penetration testing and security assessment engagements require a signed Rules of Engagement (ROE) document before any testing begins. Testing is conducted only within the agreed scope. We are not liable for any disruptions resulting from tests outside agreed parameters.
4. Intellectual Property
Client ownership: Upon full payment of all invoices, the Client receives full ownership of all custom Deliverables created specifically for them, including source code, designs, and documentation. TrustVyuh retains no rights to these upon handover.
Third-party components: Some Deliverables may include open-source libraries, fonts, or frameworks licensed under their respective open-source licences. These remain subject to those licences.
TrustVyuh IP: Any proprietary tools, frameworks, templates, or methodologies developed by TrustVyuh that are used in producing Deliverables remain the property of TrustVyuh. We grant Clients a perpetual, royalty-free licence to use such components as part of their Deliverables.
Portfolio rights: Unless agreed otherwise in writing, TrustVyuh may list the Client's name and a general description of the project in our portfolio. We will never share confidential technical details, vulnerabilities, or proprietary business information.
5. Payments and Fees
Payment structure: Projects typically require a deposit before work begins, with the remainder due upon delivery or in agreed milestones. Payment terms are specified in the individual service agreement.
Late payments: Invoices unpaid beyond the agreed due date may result in work being paused. We reserve the right to charge interest on overdue amounts at 1.5% per month.
Refunds: Work completed and delivered is non-refundable. If a project is cancelled before completion, the Client pays for work done to date at an agreed hourly or pro-rata rate.
Currency: Invoices are issued in Indian Rupees (INR) unless otherwise agreed. For international clients, invoices may be issued in USD or the agreed currency.
6. Confidentiality
Both parties agree to keep confidential all information exchanged during an engagement that is marked confidential or that would reasonably be understood to be confidential, including business strategies, security findings, technical architecture, and client data.

7. Warranties and Disclaimers
We deliver all services with reasonable care and skill. However:
- We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components.
- Cybersecurity services (including penetration testing and audits) identify known vulnerabilities at the time of testing and do not guarantee complete security. New vulnerabilities may emerge after testing is complete.
- Any advice or recommendations we provide are based on the information available to us at the time and do not constitute legal, financial, or regulatory advice.
8. Limitation of Liability
To the maximum extent permitted by applicable law, TrustVyuh's total liability to a Client for any claim arising out of or in connection with our services shall not exceed the total amount paid by the Client for the specific service giving rise to the claim in the 12 months prior to the claim.
We are not liable for indirect, incidental, consequential, or punitive damages, including loss of profits, loss of data, or business interruption, even if we have been advised of the possibility of such damages.
9. Termination
Either party may terminate an engagement by providing written notice. The Client is responsible for payment of all work completed up to the date of termination. TrustVyuh will deliver all completed work and assets to the Client upon receipt of outstanding payments.
We reserve the right to terminate an engagement immediately if the Client engages in unlawful activities, refuses to pay, or requests work that conflicts with our values or legal obligations.
10. Governing Law
These Terms are governed by the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of India.
For international Clients, we encourage resolving disputes through good-faith negotiation first. If unresolved, disputes may be referred to arbitration under the rules of the Indian Arbitration and Conciliation Act, 1996.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified by updating the "Last updated" date. Your continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
